Selecting a Bankruptcy Attorney
Questions to ask and subjects to consider in selecting an attorney;
- Specialization. The attorney should specialize in business bankruptcy, not just consumer bankruptcy. This is particularly important if your business is a corporation, partnership, or limited liability company (LLC).
- Referrals Ask others who have gone through business bankruptcy who they would recommend. Remember, business and consumer bankruptcy are two different animals, so be careful in relying on those who have gone through consumer bankruptcy.
- Good standing. Check with your state bar association to be sure the attorney is in good standing in the state.
- Comfortable Working Relationship. The attorney you choose should be someone you feel comfortable working with.
- Rates/What's Included. Ask about rates and what services are provided for those rates. For example, does the rate include working with the trustee?
You don't have to take the first attorney you interview. You will be working with this person for many months, maybe years, so be sure you are completely comfortable with the style and personality of your bankruptcy attorney.
